1. Acceptance of Terms
By accessing or using the services provided by AttackRadar Inc. ("AttackRadar," "we," "us," or "our"), including our website at attackradar.us, APIs, and all related tools and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Services
AttackRadar provides a cloud-based cyber threat intelligence and dark web monitoring platform. Our Services include, but are not limited to: real-time Indicator of Compromise (IOC) feeds, threat actor profiling, vulnerability intelligence, MITRE ATT&CK mapping, dark web credential monitoring, brand monitoring, ransomware group tracking, and related alerting and reporting capabilities.
3. Account Registration & Security
To access our Services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You must notify us immediately at support@attackradar.us of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.
4. Acceptable Use Policy
You agree not to use our Services to:
- Engage in any illegal, fraudulent, or harmful activity
- Access, scrape, or collect data from our platform using automated means without prior written authorization
- Resell, redistribute, or sublicense our threat intelligence data without a valid license agreement
- Attempt to reverse engineer, decompile, or disassemble any part of our Services
- Use threat intelligence data to harass, threaten, or harm individuals or organizations
- Upload or transmit malware, viruses, or other malicious code through our platform
- Interfere with or disrupt the integrity or performance of our Services
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
5. Subscription, Billing & Cancellation
5.1 Subscription Plans
Our Services are offered under various subscription plans (Starter, Professional, and Enterprise) with different features, usage limits, and pricing tiers. Details of each plan are available on our pricing page.
5.2 Billing
Subscription fees are billed in advance on a monthly or annual basis, depending on the billing cycle you select. All fees are quoted and payable in United States Dollars (USD). You authorize us to charge your designated payment method for all applicable fees.
5.3 Free Trial
We may offer a free trial period for certain subscription plans. At the end of the free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends. No credit card is required to start a free trial.
5.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle. No refunds will be issued for partial billing periods.
6. Intellectual Property Rights
All content, data, software, designs, logos, trademarks, and other materials associated with AttackRadar are the exclusive property of AttackRadar Inc. or its licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property except for the limited license to use the Services as described herein.
You retain ownership of any data or content you upload to our platform. By uploading data, you grant us a limited license to process, analyze, and store that data solely for the purpose of providing our Services to you.
7. Confidentiality
Each party agrees to maintain the confidentiality of any non-public information received from the other party in connection with these Terms. This obligation does not apply to information that is publicly available, independently developed, or rightfully obtained from a third party without restriction.
8. Data Processing & Security
We process data in accordance with our Privacy Policy and applicable data protection laws, including GDPR and CCPA where applicable. We maintain SOC 2 Type II certification and implement industry-standard security measures to protect your data.
9. Disclaimers & Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ATTACKRADAR DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY THREAT INTELLIGENCE DATA. OUR SERVICES ARE INFORMATIONAL IN NATURE AND SHOULD NOT BE THE SOLE BASIS FOR SECURITY DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATTACKRADAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
10. Indemnification
You agree to indemnify, defend, and hold harmless AttackRadar Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Services immediately, without prior notice, if we reasonably believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately, and we may delete your account data after a reasonable retention period.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in Wilmington, Delaware.
13. Modifications
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting a notice on our website or by email at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes your acceptance of the modified Terms.
